The New Regulatory Framework for Transfer Pricing in China

The 2008 Enterprise Income Tax Law has set out a new framework for transfer pricing in China. This framework was finally detailed last January and, among other things, imposes a new obligation on taxpayers to prepare and maintain contemporaneous documentation (i.e. documentation justifying transfer pricing to be provided to the tax authorities upon request). For 2008 transactions, contemporaneous documentation shall be ready as of December 31, 2009. For other years, the contemporaneous documentation shall be ready as of May 31 of the year following the year in which the transaction occurred.
This meeting of the tax working group aims at presenting the new transfer pricing requirements faced by taxpayers and providing guidelines on how to organize the preparation of contemporaneous documentation in the Chinese context. These issues will be addressed by the group coordinators and three transfer pricing specialists from Nera, an economic consulting firm.

Associate Director Jean-Sébastien Lénik (NERA France) will deliver introductory comments highlighting the challenges associated with transfer pricing issues in the French –Chinese context. Vice President Yasunobu Suzuki (NERA China) and Consultant Charles Fu (NERA China) will present the new Chinese transfer pricing regulatory framework emphasizing its practical consequences for multinational companies and providing insights on how to practically address the challenges set by the new Chinese regulatory framework.

Speakers :

Jean-Sébastien Lénik, NERA Economic Consulting, Associate Director – Based in Paris, Mr. Lénik is a senior economist specializing in economic analysis applied to intercompany pricing issues. He has worked with valuation and transfer pricing engagements focusing on complex transactions involving intellectual property, notably in the context of private equity deals, business restructuring, and post merger integration.

Yasunobu Suzuki, NERA Economic Consulting, Vice President

Based in Beijing and Shanghai, Mr. Suzuki is a Vice President in NERA's Transfer Pricing Practice. Prior to joining NERA, Mr. Suzuki was a partner in Transfer Pricing and China Desk at Tohmatsu Tax & Co., a Japanese member of Deloitte Touche Tohmatsu, where he was responsible for transfer pricing in China and Japan. He has worked with a range of clients from the consumer, banking, electronics, automotive, and trading industries.

Charles Fu, NERA Economic Consulting, Consultant

Based in Shanghai, Mr. Fu has more than eight years of professional experience advising clients on taxation and business issues in China. Prior to joining NERA, he worked as a senior manager for one of the Big Four accounting firms. Mr. Fu graduated from Fudan University with a BA in economics. He is a Certified Public Account and Certified Taxation Agent in China, and also an International Certified Internal Auditor.
